1. Introduction
Welcome to Cascade Enterprises. These Terms & Conditions (“Terms”) govern your access to and use of the products, services, and digital content provided by Cascade Enterprises through our website(s), including but not limited to https://n8n-workflows.ilastia.com (“Website”), n8n Workflows (Proprietary). By purchasing, downloading, or using any product or service from our Website you agree to be bound by these Terms. If you do not agree, do not purchase or use our products.
2. Definitions
- “We”, “Us”, “Our” — Cascade Enterprises.
- “You”, “User”, “Customer” — any individual or entity who accesses the Website, purchases, downloads, or uses our products.
- “Products” — Digital products sold by Cascade Enterprises, including workflow templates, tutorials, guides, code, assets, documentation, and related items.
- “Authorized Reseller” — any third party explicitly authorized by Cascade Enterprises to sell our products (if applicable).
3. Scope & Applicability
These Terms apply to all purchases, downloads, and uses of Products obtained from Cascade Enterprises via our Website. Additional terms may apply to specific products or promotions; where there is a conflict, the specific Product terms will govern.
4. Ownership & Intellectual Property
- Ownership. All Products are the exclusive property of Cascade Enterprises (or our licensors) and are protected by intellectual property laws worldwide.
- Copyright & Marks. Except for content you explicitly license from us, all copyrights, trademarks, logos, trade dress, and other intellectual property rights in and to the Products and the Website are owned by Cascade Enterprises.
- No Transfer of Title. Purchase of a Product grants you the rights described in Section 5 (License & Use) below. You do not acquire any ownership, title, or intellectual property rights in the Products unless explicitly stated in a separate written agreement.
5. License & Permitted Use
- Standard License. Upon successful purchase, Cascade Enterprises grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased Product for your internal, personal, or business purposes consistent with these Terms.
- Permitted Uses Include:
- Importing and using workflow templates in your own n8n instance.
- Using tutorials and guides for learning, implementation, or internal training.
- Customizing or adapting templates for internal business use.
- Prohibited Uses (Unless You Have a Commercial/Reseller License):
- Reselling, sublicensing, redistributing, or otherwise making the Product (or modified versions) available for sale or free distribution to third parties.
- Claiming authorship or ownership of the Product.
- Incorporating Products into offerings for resale, unless you have a separate, explicit written reseller or white-label agreement with Cascade Enterprises.
- Commercial/Reseller Licenses. If you wish to resell, white-label, or distribute Cascade Enterprises’ Products commercially, you must obtain a written reseller or distributor license from Cascade Enterprises prior to doing so. Contact contact@n8n-workflows.ilastia.com for enquiries.
6. Purchases, Payment & Delivery
- Purchase. Products are purchased on the Website. We accept payment methods displayed at checkout.
- Pricing & Taxes. All prices are as shown on the Website. You are responsible for any applicable taxes, duties, or fees. We reserve the right to change prices and fees at any time, but changes will not affect purchases already completed.
- Delivery. Upon successful payment, digital Products will be made available via immediate download links, access to a customer portal, or delivery by email, as indicated at checkout. It is your responsibility to ensure a working email address and to store downloaded files securely.
- Failed Delivery. If you do not receive your Product due to an invalid email or download failure, contact us at contact@n8n-workflows.ilastia.com and we will assist with delivery.
7. Refunds & Returns (Digital Products)
- No General Refunds. Because Products are digital and can be copied, all sales are final by default. We generally do not offer refunds.
- Exceptions. We may consider refunds in exceptional cases (for example: duplicate charges, unauthorized transactions, or proven technical failure preventing access to the Product). Requests must be submitted to contact@n8n-workflows.ilastia.com within 14 days of purchase and include your order details and a clear explanation.
- Discretion. Refunds are issued at our sole discretion. If granted, access to the Product will be revoked.
8. Support & Updates
- Support. Basic setup guidance and documentation are provided with Products. Additional support (e.g., customization, installation) may be offered for a fee or under a separate support agreement.
- Updates. We may provide updates, fixes, or new versions of Products at our discretion. Updates may be subject to additional terms or fees.
9. User Accounts & Security
If you create an account on our Website you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use or security breach.
10. Restrictions & Acceptable Use
You must not use our Products or Website to:
- Violate applicable laws or third-party rights;
- Transmit malware, spam, or illegal content;
- Circumvent security, licensing mechanisms, or access controls;
- Reverse engineer or attempt to extract underlying source code or proprietary logic, unless expressly permitted by law or a separate written license.
11. Warranties & Disclaimers
- No Warranty. Products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. Cascade Enterprises disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
- No Guarantee of Results. While Products are designed to be useful, we do not guarantee specific outcomes (e.g., revenue, traffic, or automation performance). Proper configuration, testing, and integration are your responsibility.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Cascade Enterprises and its officers, employees, agents, or partners will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, data, or business opportunities; or
- Any claim arising from your use of the Products.
Our total aggregate liability for any claim arising from or related to these Terms or any Product shall not exceed the purchase price you paid for the specific Product giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Cascade Enterprises and its affiliates from and against any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Products, or your violation of any applicable laws or third-party rights.
14. Termination
We may suspend or terminate your access to purchased Products or your account at our discretion if you violate these Terms or engage in unlawful or abusive behavior. Termination does not relieve you of obligations incurred prior to termination (including payment obligations and indemnity).
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. Before initiating formal legal action, parties agree to attempt to resolve disputes in good faith by contacting the other party at the contact details above.
16. Taxes & Duties
You are responsible for any taxes, duties, or other governmental charges applicable to your purchases, other than taxes imposed on Cascade Enterprises’ net income.
17. Third-Party Services & Links
Our Products may integrate with third-party services (e.g., OpenAI, Slack, payment gateways). Use of these third-party services may be subject to separate terms and privacy policies. Cascade Enterprises is not responsible for third-party performance or policies.
18. Modifications to Terms
We may update these Terms from time to time. When material changes occur, we will post the updated Terms on the Website with the revised effective date. Continued use after changes constitutes acceptance of the updated Terms.
19. Severability & Waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce a right is not a waiver of that right.
20. Entire Agreement
These Terms, together with any product-specific terms, privacy policies, and any written agreements between you and Cascade Enterprises, constitute the entire agreement between you and Cascade Enterprises regarding the subject matter herein.
